2. Petitioner seeks bail who is in custody since 20.08.2025 in connection with Araria Cyber P.S. Case No. 23 of 2025, F.I.R. dated 19.08.2025 for the offences punishable under Sections 318(4), 319(2), 336(2), 338 and 340 of the BNS, 2023.

3. According to prosecution case, this petitioner illegally withdrawn money from the informant's bank account and also took loan on informant's name.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the F.I.R is false and fabricated and the petitioner has not committed

5. Learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that the allegation as alleged is supported by the evidence collected during investigation by the prosecution and it has come during investigation that the petitioner has withdrawn amount in question from the bank of the informant and apart from that the petitioner has also taken loan by using Aadhar and PAN Card of the informant. Co-accused, Imroz Alam @ Md Imroz Alam has been granted bail on the ground that the petitioner is the main culprit in the present occurrence.

6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Araria Cyber P.S. Case No. 23 of 2025 pending in the court of learned CJM, Araria.

7. Prayer is refused.
