2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of Arms Act.
3. As per prosecution case, the petitioner along with co-accused persons surrounded the informant and co-accused Pankaj & Vicky Kumar put out their pistol and fired upon him due to which the informant sustained gun shot injuries. On hulla, nearby people came and brought the informant to hospital for treatment.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has
Patna High Court CR. MISC. No.666 of 2024(2) dt.16-01-2024 2/2 falsely been implicated in this case due to dispute between he parties. From perusal of FIR, the specific allegation against coaccused Pankaj Kumar and Vicky Kumar who opened fired upon the informant, causing injury in his left sole and right leg. There is no direct allegation against this petitioner. He has got no criminal antecedent and languishing in judicial custody since 19.8.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Alamganj P.S. Case No. 307 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Patna City.
