The petitioner apprehends his arrest in connection with K.Hat P.S. Case No.501 of 2024, registered for the offence punishable under Sections 21 and 22 of the N.D.P.S. Act. 3.

As per the FIR, 2.880 grams smack (brown sugar) which were kept in a small box is said to have been recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. It is further submitted that the said recovery has been made from a joint ancestral house of the petitioner and the same is also much below to small quantity. No forensic examination was done of the alleged seized material. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as well as considering that the contraband article has been recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

Accordingly, this application is dismissed.
