This is an appeal under Sections 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, against refusal of the prayer for anticipatory bail by order dated 24.10.2019 in A.B.P. No.270 of 2019 passed by the learned Exclusive Special Judge, SC/ST, Gaya in connection with Barachati Mohanpur P.S.Case No. 337 of 2015 registered under Sections 341,323,504,506,34 of the Indian Penal Code as well as under Sections 3(i)(x) of the Scheduled Castes and Scheduled Tribes Act.
Offences alleged under the Indian Penal Code against the appellant are bailable, however, in view of the prima facie allegation under the provisions of Scheduled Castes and Scheduled Tribes Act, the prayer for anticipatory bail is not maintainable.
Patna High Court CR. APP (SJ) No.5263 of 2019 dt.03-12-2019 2/2 Hence, this appeal against refusal of the prayer for anticipatory bail on the ground of non-maintainability, is dismissed as devoid of any merit. However, prayer for regular bail of the appellant shall be considered without being prejudiced by this order on its own merit.
Accordingly, this appeal stands dismissed.
