JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-02-2024 The present writ petition has been filed for seeking the following reliefs:- "1(i). For issuance of an order/direction or a writ in the nature of mandamus for commanding and directing the respondent authorities to accept the

2/4 payment of the petitioners regarding the Employment Notice Nos. 02/2022 and 03/2022 for the post of Stenographer and for the post of Court Reader-cum-Deposition Writer respectively only for the reason that the petitioners have fulfilled all the terms and conditions, i.e., mentioned in the Employment Notice.

(ii). For further prayer is that to issue an admit card to the petitioners which has been rejected due to non-payment, but unfortunately, as per the employment notice, the issue has been arisen in Column No.3(iii). It has been mentioned in the said column that "After filling up the necessary details, a candidate will have to press the 'submit Button', after which, a registration number will be generated. Thereafter, candidate will have to make payment online by following the link on the website. The candidates are advised to note down bank reference number that will be generated after making online payment. Candidates have to strictly follow the instructions showing during filling the online application form".

On the basis of said column, petitioners had pressed the submit button after filling up the necessary details, then registration number was generated. Then the petitioners had to make payment online by following the link on the website. After making successful payment, the petitioners were advised to note down bank reference number, i.e., DUK0832635 (Petitioner No.

3/4 (Petitioner No.2), DUJ9599251 (Petitioner No.3), DUJ7865217 (Petitioner No.4) and DUK1901864 (Petitioner No.5) and the said bank reference number has already been mentioned in the final submit form print out (Annexure - P/2 Series). (iii). For further prayer is that the examination of the petitioners is going to be held on 17.12.2023, therefore, immediately direction may be given to the concerned respondents to consider the payment mode of the petitioners only for the reason that their bank reference number has already been generated.

(iv). For further prayer is that the petitioners' application has been rejected after more than one year, i.e., 10.12.2023 while the petitioners' reference number has already been generated one year before, i.e., 25.10.2022 (Petitioner No.1), 16.10.2022 (Petitioner No.2), 17.10.2022 (Petitioner No.3), 10.10.2022 (Petitioner No.4) and 15.11.2022 (Petitioner No.5) (Annexure - P/2 Series).

(v). For further prayer is that the last date of the examination is 17.12.2023, and the petitioners have only one day to raise their grievances before the Hon'ble Patna High Court, which is very short period. Therefore, the petitioners pray that if their grievances will not be considered before 17.12.2023, then the concerned respondents may be directed to conduct a separate examination for the petitioners.

For further prayer is that to quash the notice dated 25.09.2023 issued by the Respondent No.2, in which it has been mentioned that the preliminary test and written test will be held on 17.12.2023 for the post of Court Reader-cumDeposition Writer and Stenographer (Hindi or English or Bilingual)."

After some arguments, the learned counsel for the petitioners seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioners to approach the Respondents authorities for redressal of their aforesaid grievances. Liberty, so sought, is granted.
