The petitioner apprehends his arrest in connection with Amour P.S. Case No. 130 of 2024 registered for the offences punishable under Sections 364(A) & 34 of the Indian Penal Code.

Prosecution case in short is that some unknown persons kidnapped the brother of the informant and demanded ransom from the informant and also threatened him to kill his brother, if the ransom is not given.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged
Patna High Court CR. MISC. No.89193 of 2024(3) dt.07-02-2025 2/3 against him and has falsely been implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has been dragged in this case on the basis of confessional statement of co-accused, namely, Dipak Kumar. There is delay of one day in lodging the case. Referring to statement of the victim recorded under Section 164 of the Cr.P.C., it is submitted that victim has not whispered anything against the petitioner. Petitioner is a man of clean antecedent. Other co-accused has been granted regular bail by this Court vide order dated 12-112024, passed in Cr. Misc. No. 51623 of 2024. 5.
On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted that co-accused has named the petitioner in the alleged occurrence.

Considering the rival submissions made by the learned counsel for the parties, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Amour P.S.
