2. The petitioners apprehend arrest in connection with Sidhwaliya P. S. Case No. 197 of 2024 dated 16-07-2024 instituted for the offence punishable under Sections 363, and 366/34 of the Indian Penal code.
3. As per prosecution case, daughter of the informant is said to have been kidnapped by the son of the petitioner No.1 for the purpose of marriage.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is submitted that petitioner No.1 is father and

No.89545 of 2024(2) dt.08-01-2025 2/3 petitioner no. 2 is sister of Badri Yadav @ Ramshankar Yadav against whom there is main allegation of kidnapping the daughter of the informant. The son of the petitioner No.1, namely, Badri Yadav @ Ramshankar Yadav married to the daughter of the informant on 10-09-2024 before the Marriage Registrar, Patna and since then they are happily leading their conjugal life. The case has been lodged only against the petitioners to harass them and there is no specific allegation against the petitioners of kidnapping the daughter of the informant. The victim is aged about 20 years, as per the FIR. Lastly, it has been submitted that petitioners have no criminal antecedents.
5. Learned APP has opposed the prayer for anticipatory bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj, in Sidhwaliya P. S. Case No. 197 of 2024, subject to the conditions laid down in Section 438(2) of
Patna High Court CR. MISC. No.89545 of 2024(2) dt.08-01-2025 3/3 the Code of Criminal Procedure, 1973.
7. The application stands allowed.
