The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 160 litres of spirit from the Wagnor Car. He submits that there is no recovery from the conscious possession of the petitioner. He submits that petitioner is the driver of the said car. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 16.10.2019.

In the facts and circumstances of the case on deposit of Rs. 10000/- in the court below/Nazarat, let the petitioner,

Patna High Court CR. MISC. No.77733 of 2019(2) dt.29-11-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cum-Special Judge, Excise, Aurangabad in connection with Gr. No. 1246 of 2019/Salaiya Police Station Case No. 68 of 2019.

Such deposit of Rs. 10,000/- shall abide by the outcome of the present pending criminal case. (Anjani Kumar Sharan, J) devendra/- U T
