NILU AGRAWAL ORAL ORDER 22-04-2019 Heard the learned counsel for the petitioner, the learned counsel appearing for the State, learned counsel appearing for the Baba Saheb Bheem Rao Ambedkar Bihar University, Muzaffarpur, (hereinafter referred to as, 'the University') and the learned counsel appearing for the State Bank of India.

Petitioner, in this writ application, prays for payment

Patna High Court CWJC No.22698 of 2018(7) dt.22-04-2019 2/3 of her pension which she was receiving till November, 2016, but, suddenly it was stopped.

Learned counsel for the petitioner submits that she had already furnished her life certificate for the years 2016, 2017 and 2018, but, still she did not receive payment of her pension from December, 2016, onwards.

Learned counsel for the State Bank of India has filed a counter affidavit stating therein that a sum of Rs.14,88,418/- has been deposited in the account of the petitioner on 16.04.2019 being arrears of pension up to February, 2019, the statement of account is contained in Annexure 'A' to the counter affidavit filed by the State Bank of India.

Learned counsel for the petitioner submits that the Bank having a core banking system the said life certificate was deposited with the State Bank of India, Main Road, Ranchi, Jharkhand, where the account of the petitioner is maintained, but, the bank officials being negligent have stopped the pension of the petitioner from December, 2016, as such she is entitled to interest on the said amount.

Considering that the pension of the petitioner from December, 2016, to February, 2019 has been paid in the account of the petitioner, this writ application is disposed of.

Patna High Court CWJC No.22698 of 2018(7) dt.22-04-2019 3/3 However, since, the petitioner being an old lady of 81 years, who retired in the year 1998 from the University, whose pension was stopped with effect from December, 2016, respondent no. 6, the Branch Manager, State Bank of India, Main Road, Ranchi, Jharkhand, would enquire into the matter and also fix responsibility on the person dealing with the matter, and interest on the arrear amount as earned by the Bank on its Fixed Deposits would be calculated and would be recoverable from the concerned delinquent officer by the Branch Manager. The amount recovered from the delinquent officer would be deposited in the account of the petitioner, within a period of three months, from the date of receipt/production of a copy of this order.
