This is an application for grant of anticipatory bail in connection with Noor Sarai P.S. Case No. 270 of 2019 registered for the offence punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding altercation having taken place in between the petitioners and the informant on account of the petitioners and the informant competing amongst themselves to pick up the passengers for their auto-rickshaw, resulting in the informant sustaining some injuries.

No.78400 of 2019(2) dt.02-12-2019 2/2 The learned counsel for the petitioners has submitted that the injuries are simple in nature, as is also noted by the learned Sessions Judge, Nalanda, Biharsharif in the impugned order dated 15.10.2019. It is submitted that the petitioners have been falsely implicated in the present case and the same has arisen on account of minor scuffle. Lastly, it is submitted that the petitioners are having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Noor Sarai P.S. Case No. 270 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
