2. The petitioner apprehends his arrest in Nokha P.S. Case No. 274 of 2023 registered for the offences punishable under Section 30(a)(d) of the Bihar Prohibition and Excise Amendment Act, 2018, pending in the Court of learned Special Judge Excise-II-cum-Additional District and Sessions Judge, Rohtas at Sasaram.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.86134 of 2023(2) dt.18-01-2024 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that the petitioner has no criminal antecedent.
