2. The present petition has been filed under Section 482 Cr.P.C. for quashing the order dated 04.09.2017 passed by the learned Sub-Judge XIV cum A.C.J.M., Patna in Gardanibagh P.S. Case No. 152 of 2017, G.R. No. 2856 of 2017 by which cognizance was taken against the petitioner for the offences under Sections 406, 420, 506/34 of the I.P.C.

3. Learned counsel for the petitioner submits that a petition under Section 239 Cr.P.C. is pending before the Court concerned. He further submits that this case may be disposed of with liberty to the petitioner to raise all the issues before the

4. Learned A.P.P. for the State has no objection to this prayer of the petitioner.

5. Accordingly, the present case is disposed of with liberty to the petitioner, as prayed for.

6. The learned Trial Court is expected to decide the petition filed under Section 239 Cr.P.C., if pending, in accordance with law expeditiously.
