The petitioner seeks regular bail in connection with Ganga Bridge P.S. Case No. 26 of 2019, registered for the offence punishable under Sections 379 and 356 of the Indian Penal Code.

The allegation is regarding the tractor of the informant being stolen by three unknown accused persons and upon investigation, the accused person, namely, Chandan Kumar was arrested and he disclosed that he had snatched the tractor from the informant and thereafter, dismantled the same with the help of the petitioner herein and had sold the dismantled parts. The learned counsel for the petitioner has submitted that

No.83019 of 2019(2) dt.13-12-2019 2/3 apart from the confessional statement of the co-accused person, namely, Chandan Kumar, there is no material on record of the case to show the complicity of the petitioner in the alleged crime. It is further submitted that the petitioner has been falsely implicated in the present case on account of his bad antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 4.7.2019.

At this juncture, the learned counsel for the petitioner has also submitted that the petitioner is ready to abide by such conditions as may be deemed fit and proper to be imposed by this Court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 26 of 2019.

It is further directed that the petitioner would mark his attendance before the Officer-in-Charge of the concerned police station at 10:30 am. on each Monday of the week and in the
