JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Spl. Case No. 5412 of 2018 arising out of Gardanibagh P.S. Case No. 221 of 2018 instituted for the offence under Sections 353, 307 of the Indian Penal Code, Sections 25(1-b)a, 26, 27, 35 of the Arms Act and Section 37(a)(b) of Bihar Excise Act.

Counsel for the petitioner submits that petitioner has not been apprehended on spot. Co-accused Rahul Kumar has been apprehended by the police in drunken state. He disclosed the name of petitioner. Counsel for the petitioner further submits that no incriminating article has been recovered from possession of the petitioner.

Petitioner is in custody since 20.7.2018 having clean antecedent.

Patna High Court Cr.Misc. No.71486 of 2018(2) dt.10-12-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Spl. Judge (Excise), Patna, in connection with Spl. Case No. 5412 of 2018 arising out of Gardanibagh P.S. Case No. 221 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
