JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-12-2019 Heard Mr. Arshad Alam, learned counsel for the petitioner and Mr. Kumar Priyadarshi, learned counsel for the respondent / Bank.

It appears from going through the petition that the representation of the petitioner, pursuant to the notice issued to him by the respondent / Bank under Section 13(2) of the SARFAESI Act, 2002 has been rejected.

After some arguments, learned counsel for the petitioner submits that he would be satisfied if a direction is given to the respondent / Bank to reconsider

Patna High Court CWJC No.23887 of 2019(2) dt.03-12-2019 2/2 his case, because his intention is to liquidate the loan. Such a direction cannot be issued to the respondent / Bank.

But considering the purpose for which the Act has been enacted, this Court expects that in case the petitioner approaches the Bank with a reasonable formula, the same shall be considered by the respondent / Bank and a reasoned order will be passed in accordance with law.

The petition stands disposed off in terms of above.
