The petitioner seeks bail in Sursand P.S. Case No. 187/2018, registered for the offences punishable under Section 392 of the Indian Penal Code. Later on, section 411 of the Indian Penal Code.

The petitioner is in custody since 20.07.2018. Allegedly, 04 miscreants boarded on two motorcycles had overtook the motorcycle of the informant and at the point of pistol they looted away a cash of Rs. 1,10,000/- and mobiles with S.I.M.

Learned counsel appearing on behalf of the petitioner has submitted that there is recovery of a sum of Rs. 8,000/-(four currency notes of Rs. 2,000/- denomination each) and he came

Patna High Court Cr.Misc. No.70227 of 2018(2) dt.03-12-2018 2/2 to be apprehended because he was also found riding a Yamaha F.G. motorcycle. Over and above suspicion, he contends that there is no material to connect the petitioner with the offence alleged. In any event he contends there is no chance of the petitioner fleeing from the course of investigation or trial. Since the petitioner has got no criminal antecedent, as stated in para 3 of the application, this application is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sitamarhi in connection with Sursand P.S. Case No. 187/2018.
