2. The petitioner apprehends arrest in connection with Sonbarsa Raj (Kash Nagar OP) PS Case No. 160 of 2017 dated 23.10.2017 instituted under Sections 363, 366A/34 of the Indian Penal Code and Section 8 of POCSO Act.
3. The allegation against the petitioner and other two accused is of enticing the minor daughter of the informant for the purpose of marriage.
4. Learned counsel for the petitioner submitted that the allegation is that abduction was for getting the girl married to the
Patna High Court CR. MISC. No.80738 of 2019 dt.20-12-2019 2/2 son of the petitioner. Learned counsel referred to the statement made by the girl under Section 164 of the Code of Criminal Procedure, 1973 in which she has not taken the name of petitioner. It was further submitted that petitioner is a lady and has been falsely implicated.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within four weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional District & Sessions Judge-cum Special Judge, Saharsa in Sonbarsa Raj (Kash Nagar OP) PS Case No. 160 of 2017, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
6. The application stands disposed off in the aforementioned terms.
