2. The petitioners apprehend arrest in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 25 of 2023 dated 10.01.2023, instituted for the offence punishable under Sections 420, 467, 468, 471/34 of the Indian Penal Code.
3. The allegation against the petitioners, is that, the petitioners got employment on the basis of fake certificate on the post of Special Survey Amin.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in
Patna High Court CR. MISC. No.5493 of 2024(2) dt.17-02-2024 2/3 this case. It is submitted that petitioners were appointed as Special Survey Amin in the year 2020 on the basis of certificates which later on was found to be forged and fabricated and thereafter the petitioners were removed from service on the basis that they have forged Diploma in Civil Engineering from CMJ, Univeristy, Meghalaya. It is further submitted that Registrar, CMJ University, Meghalaya has communicated on 27.07.2022 to the Assistant Director of Land Records and Survey, Patna that after proper verification the said Registrar communicated that petitioners alongwith others are possessing genuine and correct degree as per Section 22 of the University Grants Commission Act, 1956.
It is also submitted that without any show cause, the petitioners' services have been terminated. It is further submitted that similarly situated persons have been granted bail by a Co-ordinate Bench of this Court vide order dated 23.08.2023 passed in Criminal Miscellaneous No. 54312 of 2023. Lastly, it has been submitted that they have no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in
Patna High Court CR. MISC. No.5493 of 2024(2) dt.17-02-2024 3/3 the event of arrest / surrender of the petitioners in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 25 of 2023, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, subject to condition as laid down under Section 438(2) of the Cr.P.C..
