The petitioner in the present case is seeking regular bail in connection with Sahebganj P.S. Case No.341 of 2019 registered for the offence punishable under Sections 399/402 of the Indian Penal Code and Sections 25(1-B)a, 26/35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that the petitioner has committed no offence and the allegation as alleged in the FIR against him is totally false, fabricated and concocted.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein though one live cartridge is said to be recovered from

No.80429 of 2019(2) dt.06-12-2019 2/2 possession of this petitioner, but the facts as alleged reveal that he was riding on a motorcycle with two other persons and from the possession of other person with whom this petitioner was also present one loaded automatic pistol was recovered with two live cartridges and further that the this petitioner has got as many as four cases on his head all under Section 392 read with Section 27 of the Arms Act, this Court is not inclined to grant regular bail to the petitioner at this stage. The prayer for bail is thus refused. Let the trial be expedited.
