The petitioner seeks bail in connection with Sabour P.S. Case No. 183 of 2000, registered under Sections 307 and 324/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that this petitioner and Shivnath Goswami were seen by the informant near the window of the house. At that time, Shivnath Goswami was armed with pistol and on the order of petitioner to kill, Shivnath Goswami fired, which hit at the thigh of the wife of the informant then informant came out of and saw that Shivnath Goswami, Dashrath Goswami (Petitioner) and Narayan Goswami threatened that, if they make noise, the entire family would be

Patna High Court Cr.Misc. No.71460 of 2018(2) dt.06-12-2018 2/2 killed. The cause of occurrence is land dispute. Learned counsel for the petitioner submits that although petitioner is named in the F.I.R., but specific allegation of firing is against Shivnath Goswami. The petitioner is in custody since 11.06.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-III, Bhagalpur in connection with Sabour P.S. Case No. 183 of 2000.
