2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 324, 326, 307, 120(B), 34 of the Indian Penal Code and Sections 25(1-b)a, 26, 27, 35 of the Arms Act.

3. As per prosecution case, while the deputed constables were bringing the accused persons of difference cases for production in the court, in the meantime, some culprits started firing which hit two of the accused persons due to which they sustained injuries.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. The petitioner was not

Patna High Court CR. MISC. No.984 of 2024(2) dt.23-01-2024 2/2 apprehended from the spot. The petitioner has been roped in the present case only on the basis of confessional statement of coaccused Md. Obaish and Rambabu Rai, which has no evidentiary value in the eye of law. The petitioner has still not been put on T.I.P. It is further submitted that the petitioner is languishing in judicial custody since 09.10.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Town P.S. Case No. 227 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur.
