2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 305 and 331(4) of the BNS.

3. The case of the prosecution in short is that three unknown miscreants entered in the house of the informant and committed theft and valuable articles.

4. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. The name of this petitioner has surfaced in the confessional statement of the co-accused Md. Jamshed. Learned counsel for the petitioner has submitted that nothing has been recovered from the possession of this petitioner. Save and except the confessional

Patna High Court CR. MISC. No.83532 of 2025(2) dt.10-12-2025 2/2 statement of the co-accused, nothing is against the petitioner. Learned counsel has lastly submitted that the petitioner is languishing in judicial custody since 02.08.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of ten cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with the condition that the petitioner shall co-operate in the trial and shall be present on each and every date till the disposal of the case and shall also report Bhagwan Bazar P.S. weekly. The above named petitioner is directed to be released on bail in connection with Bhagwan Bazar P.S. Case No. 598 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saran at Chapra.
