2. The petitioners are apprehending their arrest in connection with Suppi P.S. Case No. 273 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 3(5) of the BNS.

Allegedly, on the fateful day, while the informant was coming to her house from the filed, in the meanwhile, she found that the petitioners were assaulting her son and when protest was made, all of them entered into the courtyard of the informant and assaulted her. It is specifically alleged that the petitioner No. 1 assaulted the informant by means of iron rod whereas the petitioner No. 2 assaulted her by means of wood log

4. Learned Advocate for the petitioners referring to the FIR contended that the parties are agnates and in order to resolve the dispute between them, the matter was referred to Gram Kutchery in Case No. 1/2023, however, despite resolution of the dispute, they are still bickering over the property dispute. It is also submitted that earlier also the petitioner No. 2 had instituted an FIR bearing Suppi P.S. Case No. 107/2022 against the informant and others and the present case is nothing but instituted to mount pressure for withdrawal of the earlier case. So far the injuries which are allegedly sustained to the informant, the same have been found to be simple in nature. The petitioners are persons of fair antecedent.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the informant was brutally assaulted by the petitioners leading to serious injuries.

Regard being had to the submissions made on behalf of the parties and considering the nature of accusation qua the simple injury, besides the genesis of the occurrence as well as the fair antecedent of the petitioners, let the petitioners abovenamed be released on bail, in the event of their arrest or

No.83683 of 2025(2) dt.18-12-2025 3/3 surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sitamarhi in connection with Suppi P.S. Case No. 273 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
