The instance application for regular bail has been filed by the petitioner in connection with Sarai P.S. Case No. 314 of 2021 instituated for the offence u/s 341, 302, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act. Earlier, the application for bail of the petitioner was rejected by order dated 20.03.2023 passed in Cr. Misc. No. 44112 of 2022.

In pursuance to the direction of the Court, a Report with regard to present state of trial vide dt. 07.02.2024 has been received from which, it appears that altogether eight witnesses are yet to be examined and trial Court had sought

Patna High Court CR. MISC. No.2735 of 2024(3) dt.13-03-2024 2/2 10-12 months to conclude the trial.

No fresh ground is made for reconsideration of the regular bail application of the petitioner. Accordingly, this application is rejected.

The bail application stands disposed of.

However, learned trial Court is directed to conclude the trial within six months on day to day basis, as the petitioner is languishing in judicial custody since 24.01.2022, failing which the petitioner may renew his prayer for bail application.
