The petitioner is apprehending his arrest in connection with G.O. Case No.661 of 2019 arising out of Town P.S.Case No.150 of 2019 , registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. There is recovery of 09 ltrs. of liquor from the Scooty of the petitioner.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, having no criminal antecedent.

Heard learned A.P.P. who has opposed the prayer for bail on the ground that the recovery is from the Scooty of the petitioner. .

Having heard both sides and in view of the facts and

No.78241 of 2019(2) dt.20-01-2020 2/2 circumstances, as stated above, I am not inclined to grant privilege of bail to the petitioner, however dispose of the application with direction to the petitioner to surrender before the learned court below and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this court if possible to be disposed of on the same day.

With the aforesaid observation, this application is disposed of.
