Mr. Sanjay Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 15-12-2025 Heard Mr. Ashok Kumar Jha, learned counsel for the petitioner and Mr. Sanjay Kumar Pandey, learned APP for the State.

2. The petitioner has prayed for bail in connection with Manpur P.S. Case No. 220 of 2022 registered for the offence punishable under Section 394 of the Indian Penal Code.

3. As per the case of the prosecution, unknown persons on pistol point snatched the mobile phones and the Glamour Motorcycle of the informant and fled away.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner submits that the FIR was lodged against unknown miscreants. During the course of investigation, one

He also submits that the said bike was recovered from Gautam Kumar and it has already been released in favor of the informant. He further submits that Gautam Kumar has been granted bail by learned coordinate Bench of this Court in Cr. Misc. No. 10386 of 2023. The case of this petitioner stands on better footing. Moreover, petitioner is languishing in judicial custody since 27.08.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Nalanda at Bihar Sharif in connection with Manpur P.S.
