2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition & Excise Act 2022 (Amended ) 3 . As per the prosecution case , 288.750 litres of foreign liquor was recovered from the field of one Pawan Kumar.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Petitioner is in custody since 20.11.2024 . Chargesheet has already been submitted. 5 . Learned A.P.P. for the State vehemently opposed the bail application .

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Prohibition and Ecise Court ( IInd ) Cum Additional District &Sessions Judge Hajipur Vaishali in connection with Mahua P. S. Case No. 397 of 2024 .
