2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 74, 76 and 3(5) of the B.N.S. and Sections 8 and 12 of the POCSO Act.
3. As per the prosecution case, the informant, who is a minor, alleged that this petitioner, along with another F.I.R. named accused person, attempted to molest her.
4. Learned counsel appearing for the petitioner submits and petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case with
Patna High Court CR. MISC. No.84498 of 2025(3) dt.13-03-2026 2/2 ulterior motive. Petitioner claims clean antecedents.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. and there is specific accusation that he, along with another F.I.R. named accused person, attempted to molest the informant, who is a minor. The victim in her statement recorded under Section 183 of the B.N.S.S./Section 164 of the Cr.P.C. has supported the prosecution case.
6. Considering the facts and circumstances of the case, specific and direct nature of accusation, gravity of offence and statement of the victim, the prayer for grant of anticipatory bail to the petitioner is rejected.
