2. The petitioner has prayed for bail in connection with Dhanarua P.S. Case No. 326 of 2024 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

3. The case of the prosecution, in short, is that a dacoity was committed in presence of the customers in Utkarsh Bank. However, the dacoits, three in number, entered into bank covering their faces and were able to take away only Rs. 28,100/- from the cash counter and the employees and also took away a mobile phone.

Patna High Court CR. MISC. No.87800 of 2025(3) dt.18-02-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He was remanded in this case from Dulhin Bazar P.S. Case No. 226 of 2024 wherein he has given his confessional statement. Save and except the confessional statement, there is nothing against him. No recovery has been made his possession. It has further been submitted that no T.I.P. was conducted. It has also been submitted that similarly situated co-accused, namely, Pintu Kumar has been granted bail by this Court vide Cr. Misc. No. 84916 of 2025 and co-accused Ghanshyam Bharti @ Chhotan has been granted bail by learned Co-ordinate Bench of this Court vide Cr. Misc. No. 51338 of 2025. The case of this petitioner stands on similar footing. Moreover, he is languishing in judicial custody since 02.08.2025.

5. Learned APP for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of four cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
