Earlier the prayer for bail was rejected by a Coordinate Bench of this Court vide order dated 29.8.2015 passed in Cr. Msic. No.340 75 of 2018 and again order dated 10.4.2019 passed in Cr.Misc. No.22740 of 2019.
Petitioner is not named in the FIR but his name transpired on the confessional statement of the co-accused. Apart from that he is accused in two other cases. Submission of the learned counsel for the petitioner is that except the confessional statement there is nothing against the petitioner and he is in custody for more than 21 months and two other co-accused have been granted bail vide order dated 30.8.2018 passed in Cr. Misc. No.52687 of 2018 and order
Patna High Court CR. MISC. No.83525 of 2019(2) dt.13-01-2020 2/2 dated 7.6.2018 passed in Cr. Misc. No.33087 of 2018 by a Coordinate Bench of this Court. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM IV, Begusarai in connection with Gadhpura P.S.Case No.05 of 2018 dated 2.2.2018.
With the above direction, this application is allowed.
