This application for regular bail arises out of Gurua P.S. Case No. 02 of 2000, disclosing the offences under Sections 395 and 412 of the Indian Penal Code. Allegedly, the informant's house was burgled by the miscreants, 15-20 in number. They were variously armed. The First Information Report was registered against unknown. Names of the petitioner and other co-accused persons have surfaced during the course of the investigation, on the basis of confessional statement of Arvind Paswan.

Learned counsel appearing on behalf of the petitioner has referred to paragraph-3 of the application to submit that he

Patna High Court CR. MISC. No.78003 of 2019(8) dt.19-03-2020 2/2 has no criminal antecedent. The petitioner is in custody since 06.07.2019. He has further submitted that other persons whose names figured in the course of the investigation, in similar circumstanced, have been allowed regular bail by this Court by the orders dated 29.03.2007, 26.09.2008, 28.08.2008, 22.10.2008, 15.05.2009, 21.11.2011 and 10.12.2012 passed in Cr. Misc. Nos.13505 of 2007, 31574 of 2008, 32699 of 2008, 40483 of 2008, 12087 of 2009, 37507 of 2011 and 42433 of 2012 respectively.

Considering the above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of Sri Gorakh Nath Dubey, learned Judicial Magistrate, 1st Class, Sherghati, Gaya, in connection with Gurua P.S. Case No. 02 of 2000, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
