The petitioner is apprehending his arrest in connection with Barachatty (Mohanpur) P.S.Case no.187 of 2017 , registered for offences punishable under Sections 272, 273, 414 of the Indian Penal Code and Section 2(E)/3/5/(B)/18 of Biahr Mahua Flower Act, 2006..

Allegation against the petitioner is about recovery of 100 kg. of Mahua flower from the motorcycle and the motorcycle is in the name of the petitioner.

Submission of the learned counsel for the petitioner is that though the motorcycle is in her name but she does not know driving of the motorcycle and she has falsely been implicated in this case, having no criminal antecedent. Heard learned A.P.P. also.

No.70770 of 2018(3) dt.10-04-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Barachatty (Mohanpur) P.S.Case No.187 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
