Petitioner apprehends his arrest in connection with Masaurih P.S. Case No.42 of 2013 dated 09.02.2013, registered for the offence punishable u/s 364/34 of the IPC and 302/201 of the IPC was added later, pending in the Court of learned S.D.J.M., Masaurih, Patna.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the

Patna High Court CR. MISC. No.1487 of 2024(2) dt.07-02-2024 2/2 learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that petitioner is not named in the F.I.R. and he was made accused on the confessional statement of the co-accused and considering that warrant was issued in the year, 2022 and the main accused has been acquitted by the learned Court below in S.Tr. No.1474 of 2013.
