2. The petitioner apprehends arrest in a case registered under Sections 279, 337 of the Indian Penal Code and Section 30(a) of Bihar Excise Act.
3. As per prosecution case, 10 liters illicit liquor was recovered from the motorcycle bearing Reg. No. JH03-U-9126 of which petitioner was driver.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. Petitioner was merely the driver of the vehicle and was only following the instruction of the vehicle owner. He was not aware of the nature of consignment. Nothing has been recovered
Patna High Court CR. MISC. No.110 of 2025(2) dt.04-02-2025 2/2 from the conscious possession of the petitioner. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

Considering the quantity, clean antecedent and the fact that petitioner was only a driver of the seized vehicle, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. V, Gaya, in connection with Amas P.S. Case No. 116 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
