ANJANA MISHRA ORAL ORDER 06-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 01.08.2019, in connection with Bikramganj P.S. Case No. 584 of 2018 for the offences under Sections 341, 323, 324, 325, 302, 307/34 of the Indian Penal Code and 27 of Arms Act.
Learned counsel for the petitioner submits that similarly situated co-accused persons have been granted bail in connection with the present case and one Rajesh Singh who was Petitioner No. 2 in Cr.Misc. No. 34213 of 2019 was extended the privilege of bail and the petitioner had surrendered in the Court below. But it was wrongly recorded in the order that he had been granted bail. The said order was subsequently corrected and the petitioner has filed the present bail
Patna High Court CR. MISC. No.80295 of 2019(2) dt.06-12-2019 2/2 application. Learned counsel for the petitioner further submits that no specific allegation has been attributed to the present petitioner and the allegation of firing is on one Hazari Singh and not the present petitioner.
In view of the aforementioned facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas, in connection with Bikramganj P.S. Case No. 584 of 2018.
