====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1) and 61(2) of the B.N.S., 2023.

3. As per the prosecution case, the informant, namely Kamlesh Bhuiyan, alleged that the F.I.R.-named accused persons, in conspiracy with each other, assaulted and killed the brother of the informant as he used to object to his wife's extramarital affair with co-accused Arvind Bhuiyan.

4. Learned counsel for the petitioner submits that from the F.I.R., it is apparent that the informant is not an eyewitness to the occurrence. Similarly situated co-accused person, Suresh Bhuiyan @ Suresh Rikiyasan, having similar and

Patna High Court CR. MISC. No.85055 of 2025(2) dt.09-12-2025 2/2 identical allegations, has already been granted bail by this Court vide order dated 02.12.2025 passed in Cr. Misc. No. 82821 of 2025. The petitioner is in custody since 28.06.2025, and the charge-sheet has been submitted in this case.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-Vth, Aurangabad, in connection with S. Tr. No. 615/25/157/25 arising out of Mandanpur P.S. Case No. 273 of 2025.
