JUSTICE SUDHIR SINGH ORAL ORDER 04-02-2019 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner is apprehending his arrest in a case for the offence registered under Sections 302, 120(B) of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that Anjali Kumari, daughter of Pramod Kumar Pankaj, has performed marriage with the son of the informant, Rakesh Kumar (since deceased). The Court had ordered to keep Anjali Kumari with son of the informant and for that the father of Anjali Kumari, Pramod Kumar Pankaj and his other family members became annoyed and threatened to kill the son of the informant. It is further alleged that Pramod Kumar Pankaj had caused murder of son of the informant. The informant raised suspicion against the

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused in the present case only on the basis of suspicion. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioner in the present case. Other coaccused has been granted anticipatory bail by another Coordinate Bench of this Court vide Cr. Misc. No. 12611 of 2018 order dated 24.04.2018 vide Annexure-3 to the present application.

On behalf of the learned counsels for the State and the informant, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, in connection with Ahiyapur P.S. Case No. 251 of
