2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 447, 504, 341, 506, 323, 324, 307, 379 and 34 of the Indian Penal Code and 27 of the Arms Act.
3 . As per the prosecution case , on 16.9.2023, the all the accused persons due to land dispute came at the house of informant and abused and co-accused Ritu Raj opened fire in the air. The informant remained inside the home and did not come out. It is further alleged that on next day , when informant was sitting at the door of Haridwar Sharma, his son came and informed that the accused persons once again came to their home . Patna High Court CR. MISC. No.87926 of 2024(2) dt.02-04-2025 2/3 Kumar present there with country made revolver while other coaccused were variously armed, abusing his family members. Upon objection , Prince Kumar gave 'garasa' blow on his head causing injury. He gave repeat blow causing injury on the chin once again Ritu Raj opened fire in the air. Later, wife of informant was also injured. Someone called the Police on 112 whereafter, the police came and took them to the Magadh Hospital which followed the FIR.
4. Learned counsel for the petitioner submits that specific allegation of giving 'garasa' blow to the informant's head and later on his chin is against Prince Kumar. There is general and omnibus allegation of assault against this petitioner. Doctor has found the injury simple in nature . 5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Gaya in connection with Chaandauti P.S. case No. 477 of 2023 , subject to the
Patna High Court CR. MISC. No.87926 of 2024(2) dt.02-04-2025 3/3 conditions laid down under section 438(2) of the Code of Criminal Procedure .
