Shahi, learned Senior Counsel for the petitioner, learned counsel for the informant and learned Additional Public Prosecutor for the State.

2. The petitioner seeks bail in connection with Chainpur P.S. Case No. 293/2024 registered for the offences punishable under Sections 126(2), 115(2), 109(2), 352, 103(1), 351(2) and 3(5) of B.N.S. and Section 27 of Arms Act.

3. As per the prosecution case, petitioner is accused of firing at the deceased.

4. Learned Senior Counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned Senior Counsel further submits that from the FIR, it appears that petitioner is not the assailant of the

Patna High Court CR. MISC. No.89405 of 2025(4) dt.30-03-2026 2/2 deceased, but one Kaushar Ansari is the assailant of the deceased. Petitioner has clean antecedent and he is in custody since 15.09.2025. The petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Kaimur at Bhabhua /concerned Court below in connection with Chainpur P.S. Case No. 293/2024.

8. This is also subject to the condition that the petitioner after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the Trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
