The petitioner seeks regular bail in connection with Bikramganj P.S. Case No. 584 of 2018 for the offence registered under Sections 341, 323, 324, 325, 302, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation is regarding the co-accused person namely Hazari Singh having fired at the deceased resulting in the death of the deceased and the other accused persons including the petitioner herein are stated to be his accomplice. The learned counsel for the petitioner has submitted that the death of the deceased is on account of firing made by the coaccused person, namely, Hazari Singh and no allegation of any specific overt act has been levelled as far as the petitioner is

It is further submitted that the co-accused person, namely, Shri Bhagwan Singh, has already been granted bail by a coordinate Bench of this Court vide order dated 07.05.2019 passed in Criminal Misc. No. 29874 of 2019. It is further submitted that some other co-accused persons, similarly situated, have already been granted bail. The petitioner is stated to be languishing in custody since 01.08.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, District-Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 584 of 2018.
