Petitioner apprehends his arrest in Complaint Case No.236 of 2018 registered under Section 498(A) and other sections of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is the husband. The marriage was solemnized seven years ago and on account of some petty family dispute, the wife of the petitioner lodged this case making false allegation. Petitioner is ready to keep his wife.

Taking into consideration the fact that the petitioner is still ready to keep his wife on any undertaking, petitioner is

No.75237 of 2018(3) dt.10-01-2019 2/2 directed to surrender in the court below within four weeks from the date of receipt of this order and on such the learned court below shall enlarge the petitioner on provisional bail for six months on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Katihar in connection with Complaint Case No.236 of 2018. Thereafter the learned court below shall make all efforts for resolution of the dispute between the husband and wife and if the petitioner is ready to keep his wife, the learned court below shall confirm the provisional bail of the petitioner. If the dispute is not resolved between the husband and wife then the learned court below shall pass order on the provisional bail of the petitioner immediately after six months.
