2. The petitioner is apprehending arrest in connection with Runnisaidpur P.S. Case No. 246 of 2023, registered on 14.05.2023, for the offences punishable under Sections 30(a), 32(i)(ii), 36 and 41(i)(ii) of the Bihar Prohibition and Excise (Amendment) Act.

3. As per the prosecution, total recovery of 946.77 litres of illicit liquor has been made, which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that nothing incriminating has been recovered from the petitioner's possession, and he has been falsely

Counsel further submits that the petitioner's name has figured in this case by virtue of the confessional statement of the local chowkidar. Counsel further submits that the criminal antecedent of the petitioner is not clean, there are four criminal cases pending against him. Counsel also submits that the petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

5. Learned APP for the State opposes the prayer for bail and submits that the criminal antecedent of the petitioner is not clean.

6. In the present facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioner, therefore the bail application of the petitioner is hereby rejected.

7. However, if the petitioner surrenders within four weeks from today and prays for regular bail, then the Trial Court shall pass order on the surrender- cum- bail application of the petitioner on the same day without being prejudice of the present order and the Trial Court shall pass order on the merit of this case.
