JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 19-12-2019 The petitioner superannuated from the service of the police department from West Bengal on 01.07.1996. His date of birth in his service record is 01.01.1938. According to the petitioner, inadvertently, a wrong date of birth of the petitioner has been entered in the manual and digital record of the respondent Bank in which the petitioner has an account. Because of such wrong entry of the date of birth in the Bank records, the petitioner is not getting the advantage of becoming an octogenarian account-holder. Apart from this, there is yet another

Patna High Court CWJC No.25463 of 2019 dt.19-12-2019 2/3 grievance of the petitioner that despite the period of commutation being over, unauthorizedly, an amount of Rs. 285/- per month is being deducted by the Bank. Under the aforesaid circumstances and when the respondent Bank did not pay heed to the aforesaid complaint of the petitioner, the petitioner has approached this Court for a direction to the respondent Bank to make correction in the date of birth, provide him the benefit of old age additional amount which is payable to any person of the age of eighty years and to stop deducting Rs. 285/- as the period for such compulsory deduction by way of commutation is over by now.

It is too late in the day to remind the public authorities that they are under an obligation to dispose of such complaints by their customers. The State Bank is not only a commercial venture simplicitor but has the instrumentality of the State and therefore it has a public duty as well.

As part of the public weal, a decision ought to have been taken on the representation of the petitioner by now, which unfortunately has not been taken. This leaves this Court with no option but to direct the respondent Bank to accept a fresh representation of the petitioner in which his grievance and complaints are duly charted out and if possible, such complaints be redressed or if it is not

Patna High Court CWJC No.25463 of 2019 dt.19-12-2019 3/3 possible to do so, the petitioner shall be made known the reason for the same. The entire exercise be completed within a period of four weeks of the production of a copy of this order.

The representation in that regard shall be filed by the petitioner within a period of four weeks from today. With the aforesaid direction/observation, the writ petition stands disposed of.
