ANJANA MISHRA ORAL ORDER 05-12-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioner Nos.1 and 2 are in custody since 02.09.2019 and 31.08.2019 respectively, in connection with Mehus P.S. Case No.07 of 2019 registered for the offence under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioners submits that there is a specific allegation in the F.I.R. against one Gudar Singh and the petitioners are not named in the F.I.R. It is only subsequently on the basis of some mischievous elements, that the names of the petitioners have been brought in in connection with the present case as having been the

Learned counsel for the petitioners further submits that there is nothing on record to indicate as such. It is further submitted that the victim died due to the injury of knife blow of said Gudar Singh. Considering the aforementioned facts and circumstances and that the nature of allegation is remote as against the present petitioners, let both the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Sheikhpura, in connection with Mehus P.S. Case No.07 of 2019.
