JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2018 The petitioner seeks regular bail in connection with Gardanibagh P.S. Case No. 211/18, registered for offences punishable under Section 379 of the Indian Penal Code. Petitioner is not named in the F.I.R and allegation is of theft of motorcycle of the informant.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case only on the basis of confession of co-accused and further nothing has been recovered from the possession of the petitioner rather the recovery of motorcycle was made from an open place. Petitioner has no criminal antecedent and has been in judicial custody for more than four months.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge -XIV cum Additional Chief Judicial Magistrate, Patna, in connection with Gardanibagh P.S. Case No. 211/18, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
