====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 19-12-2018 Heard Sri Kamlendra Prasad Singh, learned counsel for the petitioner and Mr. Matloob Rab, learned Addl. Public Prosecutor.

The petitioner, who is in custody in Anti P.S. Case No. 43 of 2018 registered for offence under Sections 384, 385, 387 of the Indian Penal Code and Sections 16, 18, 20 of the U.P.A. Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. He submits that in this case, F.I.R. was lodged on 09-06-2018, however without any plausible explanation, same was received on 12-06-2018 in the Court and, as such, it has been argued that the petitioner deserves to be released on bail, since it is a case of false accusation.

Patna High Court Cr.Misc. No.69919 of 2018(3) dt.19-12-2018 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail. He has also drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is also accused in number of cases.

Besides hearing, I have perused the material on record. Considering the seriousness of accusation as well as the fact that the petitioner is habitual offender, there is no need to extend the privilege of bail.

The petition stands dismissed.
