2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 420, 379, 427, 354B, 504, 506 and 34 of the Indian Penal Code.
3. As per prosecution case, co-accused Deepak Kumar fraudulently got the land of the informant executed in his name. This petitioner is alleged to be witness of the alleged sale deed.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has committed no offence. Petitioner is not the beneficiary of the alleged sale deed. He is neither vendor nor vendee. As a matter of fact, the sale deed in question was executed by the informant after getting her face and fingerprint scanned and by appearing before the Sub-Registrar and answering in affirmation regarding

He further submits that the dispute is civil in nature relating to sale and purchase of land and as such, no criminal offence is made out against this petitioner. It is further submitted that co-accused Deepak Kumar, who allegedly got the land of the complainant executed in his favour, has already been granted the privilege of anticipatory bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 15.04.2024 passed in Cr. Misc. No. 18665 of 2024. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Udakishusganj, Madhepura in connection with Aalam Nagar P.S. Case No. 288 of 2023, subject to condition as laid down
