The petitioner seeks bail in connection with Kateya P.S. Case No. 108 of 2023 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 302, 504 and 506 of the Indian Penal Code.

The allegation against the petitioner is to commit murder of the son of informant along with 19 named co-accused persons causing head and bodily injuries to informant and others, where occurrence arises out of longstanding land disputes.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22-09-2023. Petitioner is

Patna High Court CR. MISC. No.9 of 2024(2) dt.19-01-2024 2/2 stated to be man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific allegation attributed to the petitioner. Similarly situated co-accused persons have already been gratned bail by Co-ordinate Bench of this Court passed in Cr. Misc. No. 38944 of 2023, 41506 of 2023, 47150 of 2023 & 61765 of 2023. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Kateya P.S. Case No. 108 of 2023.
