The petitioner seeks bail in connection with Aurangabad (Muffasil) P.S. Case No.218 of 2023 registered for the offence punishable under sections 302 and 120-B of the Indian Penal Code.

The F.I.R. was lodged against unknown.

Subsequently, the name of the petitioner has come on the basis of the statement of alleged eye witnesses.

It has been argued by learned counsel for the petitioner that if the so called eye witnesses knew the name of the petitioner as one of the persons involved in the crime, they should have disclosed his name at the time of registration of the F.I.R. The petitioner is in custody since 30.10.2023 having clean antecedent.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Muffasil) P.S. Case No.218 of 2023, subject to the condition that he will cooperate in the trial. (Sandeep Kumar, J) pawan/- U T
