The petitioner apprehends his arrest in connection with Sugauli P.S. Case no. 113 of 2018, registered under Sections 341, 323, 324, 498(A) and 504/34 of the Indian Penal Code and Section 3/4 of D.P. Act.
The accusation is that Nikah of the petitioner was performed with the informant on 23.02.2015, but she was being tortured due to non-fulfillment of demand of motorcycle, fridge, washing machine and T.V. In the meantime, a male issue was born due to their wedlock. On 04.04.2018, when informant was at her Myaka in the meantime, her husband
Patna High Court CR. MISC. No.71412 of 2018(5) dt.12-03-2019 2/2 came there and started to abuse her due to non-fulfillment of demand of dowry. Thereafter, informant made request to fulfill this demand, but in spite of that she was assaulted through fist and slaps, while she tried to flee away, but Sk. Subhan snatched her ear ring.
Learned counsel for the petitioner submits that petitioner is the husband of the informant and he is still ready to keep his wife with full dignity. Further submission is that due to misunderstanding, the present case has been lodged by the informant.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in connection with Sugauli P.S. Case No. 113 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
